Andrew has been at the forefront of strategic litigation since 2001 and advises insurers on a range of emerging issues affecting injury claims.
Andrew has played a leading role in monitoring the effect of compensation system reforms in the USA, the EU and the Commonwealth. He worked alongside the Government on the Compensation Act 2006, which introduced regulation of claims farmers, and he was instrumental in introducing Section 2 of the Act on rehabilitation.
He is highly experienced in running cases to the Appeal Courts and has represented parties in many landmark cases in the Court of Appeal and higher courts, including: Callery v Gray on funding, Claims Direct and The Accident Group Test Cases on claims farmers' costs, Warriner v Warriner and Cooke v UBHT and others on the discount rate, Flora v Wakom on indexation of periodical payments, Rice & Thompson v DTI on liability of public bodies for asbestos exposure, and Coles v Hetherton on insurance and vehicle damage.
In 2009, Andrew was one of the panel of assessors appointed by Lord Justice Jackson in his Review of Civil Litigation Costs. He worked closely with the insurance industry and Government to ensure that these recommendations, including the ban on PI referral fees, were implemented correctly, via the Legal Aid, Sentencing and Punishment of Offenders Act 2012.
He coordinated and ran the successful challenge to the Court of Appeal's initial ruling in Simmons v Castle (No 2), to ensure the transitional provisions were properly applied. This led to the Legal Business Award for Insurance Team of the Year 2013.
He continues to advise on the application of the ban on referral fees, including the regulatory requirements for legal service providers and for insurers and intermediaries.
Andrew is a former President of FOIL and was a member of the Civil Procedure Rule Committee until 2009. He is now a Solicitor Member of the Civil Justice Council and a member of the Council's Executive Committee. He is currently working closely with various stakeholders on the Government's whiplash reform agenda and related initiatives.
